The newly revised Work Safety Law has been reviewed and adopted by the Standing Committee of the National People’s Congress and officially came into effect on December 1.

 

“The new Work Safety Law features several significant changes: increased accountability, harsher penalties, and strengthened oversight.” The revised Work Safety Law further tightens penalties for violations and clarifies the primary responsibility of enterprises for work safety.

 

The new Work Safety Law has established a strict red line for work safety and strengthened accountability for violations of work safety laws and regulations. The law specifies the following fines: RMB 200,000 to 500,000 for general accidents, RMB 500,000 to 1 million for major accidents, RMB 1 million to 5 million for serious accidents, and RMB 5 million to 10 million for particularly serious accidents; for particularly serious accidents involving especially grave circumstances, the fine shall be RMB 10 million to 20 million.

 

In addition, the new Work Safety Law clarifies the principal responsibility of enterprises and sets forth higher requirements. For example, the principal person in charge of a production and business entity shall organize the formulation and implementation of the entity’s work safety education and training plan; the work safety responsibility system of such entities shall clearly define the responsible personnel, scope of responsibilities, and performance assessment criteria for each position; and relevant production and business entities shall, in accordance with regulations, allocate and use work safety funds exclusively for improving work safety conditions, among other provisions.
